Call for Comments: Implementation of the European Single Procurement Document and the Public Procurement Act

On February 22nd, 2018, AmCham leadership met with representatives of the Public Procurement Agency

to discuss a joint event in April 2018, with the participation of Ms. Miglena Pavlova, Executive Director of the Agency, and other experts from her team. The event will provide insights into the upcoming changes of the Public Procurement Act, expected in the autumn of 2018, and will create a platform for discussion on best European practices of implementing the European Single Procurement Document (ESPD).

To make the event more relevant to you and to streamline the discussion, we kindly invite you to share your corporate experience and/or inquire after best practices in Estonia, France, Hungary, Italy, Poland, Romania and other European markets, and make proposals for implementation of similar practices in Bulgaria, in relation to the following issues:

  1. Persons who should sign the ESPD and general recommendations for ESPD implementation.
  2. Implementation of Art. 44 of the PPA – using the possibility to conduct preliminary market consultations in the preparation of public procurement.
  3. Formulation and implementation of the award criterion referred to in Art. 70, para. 2, p. 2 of the PPA (“cost level, considering cost-effectiveness, including life-cycle costs”).
  4. Introduction of standardized forms for framework agreements to allow the use of Building Information Modeling in public procurement.
  5. Other issues related to the implementation of the PPA.

The input we collect will be considered by the AmCham Board of Directors and will serve for the preparation of recommendations of the Chamber in relation to the draft Act of Amendment and Supplement of the PPA.
